Gather Well LLC (“Gather,” “we,” “us,” or “our”) provides software infrastructure that enables independent organizations (“Community Operators”) to create and manage branded digital community platforms (“Community Apps”).
This Privacy Policy describes how Gather processes personal information in connection with:
• our website located at https://www.joingather.org and related webpages (the “Site”); and
• the hosted software platform, applications, messaging systems, and related technical services we provide to Community Operators and users of Community Apps (collectively, the “Platform”).
This Privacy Policy is incorporated into and forms part of the Terms of Use available at https://joingather.org/terms-of-use (the “Terms”).
Depending on how a Community App is structured, the applicable Community Operator may act as the primary controller or business responsible for user data collected through that Community App, while Gather may act as a processor, service provider, or infrastructure provider acting on behalf of the Community Operator.
By accessing or using the Site or a Community App, you acknowledge the practices described in this Privacy Policy.
1. Information We Collect
Through your use of the Site, the Platform, or a Community App, Gather may process information that identifies, relates to, describes, or could reasonably be associated with you (“Personal Information”).
We may collect Personal Information:
• directly from you;
• automatically through your use of the Site or Platform; and
• from Community Operators, service providers, or third parties acting on behalf of a Community Operator.
The categories of Personal Information processed through the Platform may include:
• Contact information, such as name, email address, phone number, or account identifiers;
• Authentication and login information;
• Communications, messages, files, photos, videos, or other content submitted within a Community App;
• Transaction or payment-related information where payments or donations are enabled through a Community App;
• Information voluntarily provided through forms, surveys, support requests, or event registrations;
• Device, browser, usage, log, and diagnostic information, including IP address and approximate location information; and
• Analytics and interaction information relating to use of the Platform or Site.
The specific categories of information collected may vary depending on the functionality enabled by the applicable Community Operator.
2. How We Use Information
Gather may use Personal Information to:
• operate, maintain, secure, and improve the Platform and Site;
• provide hosting, authentication, messaging, technical support, and related services;
• support Community Operators in administering Community Apps;
• communicate with users regarding accounts, security, updates, or support matters;
• analyze usage and improve functionality, reliability, and security;
• comply with legal obligations and enforce our Terms; and
• detect, prevent, investigate, or address fraud, abuse, security incidents, or technical issues.
3. Role of Community Operators
Community Apps are independently administered by Community Operators, not by Gather.
Community Operators may collect, access, manage, moderate, export, or delete information made available within their Community Apps in accordance with their own policies, practices, and legal obligations.
Gather processes certain information on behalf of Community Operators in order to provide hosting, infrastructure, communications, authentication, technical support, security, and related platform services.
Questions regarding a specific Community Operator’s community practices, membership decisions, programs, or internal policies should be directed to the applicable Community Operator.
4. Third-Party Disclosures
We may share Personal Information in the following circumstances:
a. Service Providers and Subprocessors
We may share information with third-party vendors, hosting providers, cloud infrastructure providers, analytics providers, authentication providers, communications vendors, payment processors, customer support providers, and other subprocessors necessary to operate the Platform.
b. Legal and Regulatory Requirements
We may disclose information where reasonably necessary to comply with applicable law, regulation, legal process, governmental request, court order, or enforceable subpoena.
c. Business Transfers
Information may be disclosed or transferred in connection with a merger, financing transaction, acquisition, reorganization, sale of assets, bankruptcy, or other corporate transaction.
d. With Consent
We may disclose information where you direct us to do so or otherwise provide consent.
5. Aggregated or De-Identified Information
We may use and disclose aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you.
6. Third-Party Services
The Site or Community Apps may contain links to third-party websites, integrations, or services (“Third-Party Services”).
Your access to and use of Third-Party Services are governed by the terms and privacy policies of those third parties, not this Privacy Policy.
Gather is not responsible for the privacy, security, or content practices of Third-Party Services.
7. Your Choices
You may decline to provide certain information; however, doing so may limit access to some Platform or Community App functionality.
If you no longer wish to receive marketing communications from Gather, you may unsubscribe using the instructions included in those communications or contact us at legal@joingather.org.
Community Operators may separately communicate with users of their Community Apps in accordance with their own policies and practices.
8. Children’s Privacy
The Site, Platform, and Community Apps are not intended for children under thirteen (13) years of age.
We do not knowingly collect Personal Information directly from children under thirteen (13). If you believe a child under thirteen (13) has provided Personal Information through the Platform, please contact us at legal@joingather.org.
9. Data Security
We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction.
However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
10. International Users
The Site and Platform are controlled and operated from the United States.
If you access the Platform from outside the United States, you understand that your information may be transferred to, processed, and stored in the United States or other jurisdictions where our service providers operate.
Where required by applicable law, we rely on lawful transfer mechanisms and appropriate safeguards for international data transfers.
If you reside in the European Economic Area (“EEA”) or the United Kingdom, we process Personal Information only where we have an applicable legal basis, including:
• your consent;
• performance of a contract;
• compliance with legal obligations;
• legitimate interests that are not overridden by your rights and freedoms; or
• protection of vital interests.
Subject to applicable law, you may have rights to request access to, correction of, deletion of, restriction of, or portability of your Personal Information, or to object to certain processing activities.
Requests relating to information controlled by a Community Operator may need to be directed to the applicable Community Operator.

11. Do Not Track Signals
Certain web browsers may allow you to send “Do Not Track” (“DNT”) signals.
At this time, the Site and Platform do not respond to DNT signals or similar browser-based tracking preferences.
12. Community Operator Policies
Certain Community Operators may publish additional community guidelines, privacy notices, consent terms, or membership policies applicable to their Community Apps.
In the event of a conflict between those policies and this Privacy Policy with respect to Community Operator activities, the applicable Community Operator policies may govern their handling of user information.
13. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in the Platform, legal requirements, or our information practices.
Updated versions become effective upon posting or other reasonable notice. The “Last Updated” date above indicates when this Privacy Policy was most recently revised.
